TERMS AND CONDITIONS FOR TVS DIGITAL CONTEST-KONSERT BERKAT GAWAI-KAAMATAN
The Terms and Conditions below are for the digital contest held by Sarawak Media Group (“the Contest”) in conjunction with Konsert Berkat Gawai-Kaamatan during Sambutan Hari Gawai.
Sarawak Media Group (“SMG”) is a company that owns and operates, amongst others, a television channel nationwide (i.e. TVS channel). SMG held Konsert Berkat Gawai-Kaamatan (“the Event”) which will be aired on TVS channel on 31 May 2023, 1, 4 and 6 June 2023.
Any person join and enter for the Contest shall be referred to as the “Participant”.
1. Introduction
1.1 These rules apply only to entries received from Malaysia.
1.2 To enter the Contest the Participant must enter as directed under this Terms and Conditions.
1.3 The Contest is free to enter (no purchase required, unless otherwise stated).
2. Eligibility and entry restrictions
To be eligible to enter the Contest:
2.1 Participant must be a legal residents who are physically located within Kuching, Sarawak;
2.2 Participant must be a real person, at least 18 years old (proof of age may be required);
2.3 Participant must not be SMG’s employee, officer or agent, or an employee, officer or agent of any person or organisation involved in the running of the Contest, and Participant must not be a family relation of any such person;
2.4 Participant must have a genuine social media account specifically for Instagram, Facebook, TikTok and/or Twitter (“Social Media Account”) and Participant have to keep their Social Media Account public in order to enter the Contest;
2.5 Participant have to upload their video celebrating Sambutan Hari Gawai while watching the Event on TVS channel (“Submission Materials”) with the hashtag #berkatgawaitvs as part of the entry process;
2.6 There is no limitation on the number of Submission Materials. i.e multiple submissions are allowed.
3. Submission Materials
3.1 By entering, Participant agree to be bound by the decisions of SMG, these Terms and Conditions and to comply with all federal, provincial, state, and local laws and regulations. SMG and those working for SMG or on behalf of SMG, will not be responsible, or for Internet, computer hardware and software, phone, and/or any other technical errors, malfunctions, and delays. Entries or Submission Materials which are mutilated, incomplete, illegible, inaccurate, forged, irregular in any way, or otherwise not in compliance with these Official Rules are void;
3.2 The entry and Submission Materials shall be deemed to have been submitted by the authorized holder of the Social Media Account (“authorized account holder”) visible to the SMG. The authorized account holder must be the natural person to whom an Instagram or Facebook is assigned by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning Instagram or Facebook accounts for the domain associated with the submitted email address; and
3.3 The Submission Materials may not contain references which are obscene, crude or vulgar, gang identification, references to commercial products which not related to product given and/ or provided by TVS during the Event and the Contest, phone numbers, personal addresses (physical or email), Web site URLs, derogatory characterizations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behaviour or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by SMG, in its sole discretion.
4. Start and closing dates
4.1 An entry start on 31 May 2023 and shall close on 15 June 2023.
4.2 Any entries received before the opening or after the closing date will be invalid and will not be entered as Participant.
4.3 SMG reserve the right to cancel or amend the Contest and these Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of our control.
4.4 Entry into the Contest will be deemed as acceptance of all of these terms and conditions stated herein.
5. Winners and prizes
5.1 The results of the Contest will be announced by SMG within thirty (30) days following the closing date of the Contest. The announcement may include the name and photograph, the town or region of residence and prize details of each prize winner.
5.2 The Contest prize result and winners will be notified by email (if address is asked for/provided) or by direct message on Social Media Account and/ or through phone (winners must therefore ‘follow’ TVS social media accounts in order to be contacted about prizes) not more than 30 days following the closing date of the Contest, and will receive their prizes not more than 60 days following that closing date.
5.3 Reasonable efforts will be made to contact the prize winner for fourteen (14) days but if the winner fails to respond to our notification attempts within this time or provide an address for delivery of the prize or fails to meet any of the eligibility requirements or is otherwise unable to comply with the Contest terms and conditions, SMG reserve the right to disqualify that entrant of the participant and offer the prize to the next eligible entrant participants and thereafter until a winner is found.
5.4 No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to SMG and SMG reserve the right to substitute any prize with another of equivalent value without giving notice.
5.5 Utilization of the prizes shall be subject to the terms and conditions of the SMG. SMG shall not be liable for any failure of the Participant who win the Contest to use the prize.
5.6 All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in the Contest and to redeem the prize is the sole responsibility of the Participant(s) and/or winner(s).
5.7 Participant is responsible for any and all taxes payable as a result of a prize being awarded or received.
6. Copyright and Publicity
6.1 Participant grant to SMG rights to store, edit, distribute, transmit and publish Participant’s Submission Materials.
6.2 Submission Materials become the property of SMG and will not be acknowledged or returned.
6.3 Regarding the Submission Materials, the Participant represent and warrant that:

8.1 By entering the Contest, each Participant consent to the collection, use and distribution of his/her personal information (information that identifies Participant as an individual, such as, but not limited to, home telephone number, age and home address) by SMG for the purposes of implementing, administering and fulfilling the Contest. SMG will not sell or transmit this information to third parties other than for the purpose of the Contest.
9. Issues of Law
9.1 The Contest and these Terms and Conditions will be governed by Malaysian law and any disputes will be subject to the exclusive jurisdiction of the courts of Malaysia.
10. Amendment
10.1 SMG reserves the right to at any time, change, amend, delete or add to the terms and conditions herein and other rules and regulations including the mechanism of the Contest at its absolute discretion.
